1. Introduction

MyTutorWeb Ltd (“MyTutor”) was founded to offer life-changing tuition for all. We are committed to operating with integrity, transparency and accountability, and to maintaining a safe environment for students, tutors, employees and all those who engage with our services.

Safeguarding is everyone’s responsibility. MyTutor is committed to safeguarding and promoting the welfare of children and young people and expects all employees, tutors, contractors and partners to share this commitment.

This Whistleblowing Policy sets out how concerns about wrongdoing can be raised safely, confidentially and without fear of detriment.

2. Policy Statement

MyTutor encourages individuals to raise concerns about wrongdoing, malpractice or risks in the public interest. We are committed to ensuring that anyone who raises a genuine concern under this policy is supported and protected.

No individual should suffer detriment, victimisation or disadvantage as a result of raising a whistleblowing concern in good faith.

3. Aims and Scope of the Policy

This policy applies to:

  • Employees

  • Tutors (including workers and contractors)

  • Consultants, freelancers and agency staff

  • Directors and senior leaders

This policy covers disclosures made in the public interest, in line with the Public Interest Disclosure Act 1998 and subsequent legislation.

Concerns may relate to (but are not limited to):

  • Criminal offences

  • Breach of legal obligations

  • Safeguarding or child protection concerns

  • Health and safety risks

  • Sexual harassment or misconduct

  • Fraud, bribery or corruption

  • Miscarriages of justice

  • Environmental damage

  • Attempts to conceal any of the above

Important update:

In line with the Employment Rights Act 2026, disclosures relating to sexual harassment are treated as protected disclosures under whistleblowing legislation.

This policy does not replace MyTutor’s Complaints Policy or Grievance Procedure, which are intended for personal employment-related concerns.

4. Safeguards

MyTutor recognises that raising a concern can be difficult. We will:

  • Treat all concerns seriously

  • Act promptly and fairly

  • Protect individuals from retaliation or victimisation

  • Take appropriate action where wrongdoing is identified

No individual will be penalised for raising a concern that later proves to be unfounded, provided it was raised honestly and in good faith.

5. Confidentiality

All concerns will be handled sensitively and confidentially. We will make every effort to protect the identity of the individual raising a concern.

There may be circumstances where disclosure of identity is required (for example, where required by law or during formal proceedings). In such cases, this will be discussed wherever possible.

6. Anonymous Allegations

Anonymous concerns may be considered, but they can be harder to investigate effectively. Individuals are encouraged to raise concerns openly or confidentially rather than anonymously.

When considering anonymous disclosures, MyTutor will take into account:

  • The seriousness of the concern

  • The credibility of the information

  • The likelihood of obtaining evidence

7. Untrue or Malicious Allegations

If a concern is raised in good faith but not substantiated, no action will be taken against the individual.

However, if an allegation is found to be deliberately false, malicious or made for personal gain, disciplinary or contractual action may be taken.

8. How to Raise a Concern

Concerns can be raised in the following ways:

Employees

  • Raise concerns with your Line Manager where appropriate

  • If this is not suitable, contact the People / HR Team

Tutors

  • Raise concerns via the MyTutor safeguarding or reporting mechanisms

  • Contact the business directly if preferred

Customers

  • Contact the business directly

Contact details

Concerns may be raised verbally or in writing. When raising a concern, it is helpful to include:

  • Background and context

  • Key facts (dates, individuals involved)

  • Why you believe the issue is a concern

You are not expected to prove wrongdoing, only to raise concerns you reasonably believe to be true.

9. How MyTutor Will Respond

MyTutor will:

  • Acknowledge receipt of the concern

  • Assess whether investigation is required

  • Determine the appropriate course of action

  • Keep the individual informed, where possible and lawful

Safeguarding concerns will be escalated immediately in line with statutory safeguarding procedures, including referral to external authorities where required.

10. Safeguarding, DBS and Duty to Report

MyTutor has a legal duty to act where safeguarding thresholds are met and to refer concerns to the appropriate authorities.

This may include:

  • Referrals to the Disclosure and Barring Service (DBS) where required

  • Escalation to the Local Authority Designated Officer (LADO)

  • Reporting concerns to relevant statutory or regulatory bodies

The safety and welfare of children and vulnerable individuals always takes priority.

Any concern relating to the safety or welfare of a child or young person will be treated as a safeguarding matter and handled with the highest level of urgency. This includes concerns about abuse, neglect, exploitation, or any failure to safeguard a child.

Safeguarding concerns are managed in line with relevant legislation and statutory guidance, including:

  • the Children Act 1989

  • the Children Act 2004

  • current statutory safeguarding guidance and recognised best practice

Concerns may be raised internally through MyTutor’s reporting channels or, where appropriate, escalated directly to external safeguarding bodies.

11. External Disclosures

This policy is designed to allow concerns to be raised internally. However, the law recognises that in some circumstances external reporting may be appropriate.

External support and advice is available from:

Protect (Independent Whistleblowing Charity)

NSPCC (for safeguarding concerns)

Individuals are encouraged to seek advice before making external disclosures.

12. Protection for Whistleblowers

Individuals raising concerns under this policy are legally protected from detriment.

If you believe you have been subjected to retaliation or disadvantage as a result of raising a concern, you should contact the People Team immediately. Any such treatment will be taken seriously and addressed.

13. Monitoring and Review

This policy will be reviewed regularly to ensure it remains:

  • Legally compliant

  • Aligned with safeguarding guidance

  • Reflective of best practice

Updates will be made in line with legislative changes and organisational learning.
